The Guide is composed of six chapters that address the issue of non-conviction-based forfeiture from the recent case studies of GAFILAT member countries. Its conclusions are based on the evidence that asset recovery remains marginal in most countries. In that context, the Practical Guide briefly sets out the status of implementation and identifies the underlying problems and the different forms of non-conviction based forfeiture that exist in GAFILAT member countries, with a particular emphasis on asset forfeiture.
The Practical Guide finds that economic crime requires an efficient, effective and reinvigorated criminal policy response and that, in this context, asset forfeiture appears to be the most viable option. In this sense, the concluding part formulates some considerations that seek to align its practice with international standards in order to promote its global application. A key part of this effort is undoubtedly the respect for human rights, whose observance should guarantee the acceptance of the Extinction of ownership as an action that complies with the standards that the international community has defined for this type of law.
